The
scholars' disagree over the law of circumcision into 3 opinions as follows:
The first opinion, the circumcision of the law is obligatory,
both for men and women. And that is the opinion of Imam Shafi'.
The second opinion, circumcision is the sunnah for men and
women. And that is the opinion of Imam Abu Hanifa and Imam Hasan Al-Basri.
Third opinion, His law circumcision is mandatory for men and sunnah for women.
And that is the madhhab of Imam Malik and some Imam Shafi' and Imam Ahmad.
While the
proposition of the 'ulama' which obliges circumcision, both men and women are
as follows:
1.
Circumcision is part of the sunnah of nature, ie the sunnah taught by the
Prophets Alaihimus Salam.
2.
Circumcision among the teachings of the prophet Ibrohim AS. And the Prophet and
his people were commanded to follow some of his teachings. As the command is
contained in the following verse:
ثم أوحينا إليك أن اتبع ملة إبراهيم حنيفا وما كان من المشركين
Then we revealed to you (Muhammad) follow the religion of Ibrohim
a hanif and not including those who associate with Allah. [1]
3. Because
Prophet SAW ordered his new convert to Islam to circumcise. Where the Prophet SAW
said to him:
ألق عنك شعر الكفر واختتن
Throw out of you the hair of kufr and Circumcision. [2]

Circumcision is part of the Shari'a of Muslims which is a differentiator of the
Jews and Christians. So that the law is obliged to implement it as the
implementation of other Islamic Shari'a.
5.
Circumcision is cutting a part of the body. But cutting the limbs in Islam is
an act that is paraphrased. No prohibition is allowed except for something that
is mandatory. So with this qoidah base, means law circumcision is mandatory.
6. Is
allowed to open aurot at the time of circumcision. Though opening aurot
including something that is prohibited in the religion of Islam. Thus it means
that the law is obligatory. Because it is not permissible to do an act that is
paraphrased except for something very strong obligations.
7.
Circumcision is an attempt to keep our body from being unclean which is a
requirement for the validity of the prayer. If not circumcised, then the rest
of urine will be retained in the foreskin that covers the head of the penis.
And if circumcised, will cut off the foreskin covering the penis. So
ascertained there is no longer the rest of the urine contained in it. Thus,
circumcision makes the body free from unclean.
So with the
reasons mentioned above, scholars' declared that the law of circumcision on
boys is mandatory. While circumcision for women we will discuss after this
chapter.
